Research On The Forestry Administrative Licensing Hearing System In China

This paper takes the existing "Forestry Administrative Permit Hearing Procedures" as the main line, using the methodology of historical, summarizing and comparative research, etc. The paper starts from analyzing the concept and theory origin of the hearing system and points out its strengths and shortcomings based on analyzing in depth of the basic principles and the significance and comparing the hearing system with the system adopted by other ministries and local governments. On this basis, the paper proposes some suggestions for the changes on improving the forestry administrative permit hearing system from the perspectives of the scope, subjects and procedures of the hearing system, puts forwards the adoption of the listing approaches and specifying the hearing matters on account of the defects of the forestry administrative permit hearing system, through a clear qualification of the chairperson and specifying the main responsibilities to further strengthen the independence of the chairperson considering the matter of the shortcomings of the hearing subjects, and finally integrates a number of procedures on the hearing imparting matters and the recorded hearing transcripts to regulate the existence of a large number of discretion on the executive power.
