Study On Property System Of Grassland Resources

Grassland resource is one of the irreplaceable materials for the socio-economic sustainable development. China is a country rich in grassland resource and with a total prairie area more than 400 million hectares, which accounted 41.7% for the national area and 10% for the world's grassland area, ranking second in the world only after Australia. Sustainable use of grassland is directly related to our national ecological security, regional coordination of economic and social development, building an environment-friendly society and other strategic issues. Considering the importance of grassland resource, the certain law made an adjustment for the development and utilization, as well as the protection of the grassland resource. "Grassland Law of The People's Republic of China" is China's first specialized law for protection of grassland resource. It is passed on June 18,1985 during the 11th meeting of the Sixth National People's Congress Standing Committee and made an amendment on December 28,2002 during the 31st meeting of the Ninth National People's Congress Standing Committee, then went into effort on March 1,2003. The "Property Law of People's Republic of China", which is put into effort on October 1,2007 brings grassland resource into the adjustment scope of civil law property rights and establishes the objective status of grassland resource. However, the system of grassland resource in the current legislation is too principled and vague to practice it.This thesis aims to make a study of the property system of grassland resource and is divided into three chapters. The first chapter is the basic category of grassland resource property rights. It makes a systematic discussion of grassland resource and its value, the theoretical basis of grassland resource belonging to the adjustment of property law, the legislative change and development of grassland resource interest and the principle of grassland resource property law. Chapter two describe the basic system of grassland resource property. Chapter three is the problems existed in the system, which discusses the cognition and legal provision of the ownership, use right as well as contract and management right of grassland resource. It also discusses the problems and how to complete them. This chapter emphasizes on analyzing the ownership of grassland resource and the current situation of circulation system, so to find out the practical problems and to make suggestions to help the completion of China's Property System of Grassland Resource.
