The Researching On Chun-qiu-jue-yu Of Han Dynasty Period

The researching object of this paper is Chun-qiu-jue-yu cases of the Han dynasty period. On the first,the author makes a careful analysis of the "Zouyanshu" in Zhangjiashan bamboo slips of the Han dynasty and draw a conclusion that the climate of conviction of heart of Chun-qiu-jue-yu originated from Chun-qiu period of the Eastern Zhou. Secondly, an observation of judicial environment of "Confucian classics argumentation first" of the Han dynasty is given, aiming to expound the relationship between the Confucianism and the Han dynasty law, and further clearly reveal under what kind of circumstances was Chun-qiu-jue-yu carried out.At last, the author comes to a conclusion that Chun-qiu-jue-yu in fact is the cautious penalty to relieve toughness of the Han dynasty law through an analysis of typical cases of Chun-qiu-jue-yu during the Han dynasty period.
