Study On The Legalization Of Local Government Cooperation In China

The local government partnership is one of the main contents of intergovernmental relations. It's a partnership of the same level local governments without administrative subordinate relationship or different levels of local governments. This partnership not only includes the cooperation between the local governments and cross-regional economic and social development, polluted river regulation, road construction, also cooperation of legislation, judicature and other fields.Under the highly concentrated traditional planned economy system, China implemented "every"-based centralized management system and local governments are totally dependent on central government. During this period, the fundamental characteristic of government relations was longitudinal dominant and horizontal barriered, mainly expressed as a competition relationship. After the reform and opening up, the central decentralization to the local and market reforms carrying forward have greatly strengthened the economic ties between various regions and promoted the horizontal cooperation among the various local governments. In recent years, the scope and areas of local government cooperation have become continuous expansion and scale of cooperation has been expanding formed as the Pan-Yangtze Delta, the Pan-Pearl River Delta and Bo sea rim economic zone and other important economic regions. Also, a new economic region will become and local government cooperation will be strengthened coupled with the admission and implemention of the relocate plan of Wanjiang continued industries to demonstration area. However, on the other hand, we should also see the existing local government cooperation still stay at the surface, many cooperation in name only, local protectionism, regional redundant construction, and resource waste still exists in large, which severely hampered the local government cooperation to depth. Therefore, how to coordinate the relationship between local governments, regulate local governments behavior and promote the orderly development of cooperation among local governments has become an important issue to solve at the present stage. In previous studies, scholars mainly researched from the perspective of economics and management to concern the relationship between central government and local governments, while less concerned about the increasingly close ties of cooperation between local governments. With the regional economic development, the coordination of partnerships between local governments is very important. The former proposed adjustments to the administrative divisions thought was not actual operational. At present, the government has taken regular consultations problem-solving mechanisms are popular questioned because of poor results. Therefore, through the legal means to regulate the system of local government behavior, applying the law to coordinate the relationship between local governments and maintaining the healthy development of the regional economy, cooperation between the local governments into the legal system has become inherent meaning of this topic.This paper studies the relationship does not have the administrative subordinate cooperation between local governments, analysis of the status of local government cooperation and problems. Also, it analyses the local government cooperation on legal issues involved from a legal perspective, draws on the experience of foreign issues in dealing with this problem aiming at the China problems in local government cooperation, and puts forward the recommendations of legal system cooperation with local governments in China.This paper is divided into five parts. The first part is introduction, mainly describing the background of selected topic, the relevant definition of the concept and its research overview and so on. The second part analyses the profile of local government cooperation and exciting problems such as lack of unified planning, less institutionalized, local protectionism and lack of relevant laws and system for protection and so on. The third part analyses China local government cooperation in legal issues from the legal point of view including the basis of local governments cooperation, cooperative forms of organization and the analysis of cooperation legal documents nature. Part four mainly introduces foreign experience in dealing with local government cooperation, analyses specific approach in the relevant country and the reference value to China. Part five combines our national conditions with the status of local government cooperation, and put forward personally proposals on the realization path of China local government cooperation coming into legalization system.
