The Study Of Legal System Of Rural Credit Grantee Institutions

Credit difficulty is currently a common problem in China's rural areas. This problem seriously influenced stable development of agriculture, improvement of farmers'income and process of new rural construction. It is one of core issues in China's"countryside, agriculture and farmers"development that how to fully play guarantee's leverage and to efficiently solve rural financing difficulty. The thesis is based on specific background and reality of development of rural credit grantee institutions of our country, and focuses on protection and promotion of rural credit guarantee institutions, and makes deep analysis of value pursuit, policy aim and system status of legal system of rural credit guarantee institutions, and tries to discuss that rural credit guarantee institutions need legal support and how to construct and improve legal system of rural credit guarantee institutions. The thesis consists of four parts. The first part is introduction. It mainly introduces study background, current academic study, study significance, theoretical premise, study methods, etc.The second part is overview of legal system of rural credit guarantee institutions. It first makes a macro discussion about rural credit guarantee institutions and its background, including concept, historical development and value of rural credit guarantee institutions, status of rural guarantee system and so on. Then it makes discussion about legal system of rural credit guarantee institutions, draws lessons from many failed reforms of rural credit cooperatives, analyses legal relation inside and outside rural credit guarantee institutions and important role of law in construction of rural credit guarantee institutions, and tides up current relevant legislation and its problems.The third part is construction experience of foreign rural credit guarantee institutions. To compare India of agriculture and large population, Japan and South Korea with character of small-peasant economy, and America with high-developed agriculture, then find construction plan of rural credit guarantee institutions in line with China's condition.The fourth part is suggestions of China's system choice and improvement of legal system. First it tells system choice and that construct what rural credit guarantee institutions. Then it describes complete way of current legal system, consisting of working out Credit Guarantee Institutions Law of People's Republic of China, improving supervision system, industry self-discipline mechanism, and so on. This is the core of the thesis.The thesis tries to stand on the forefront of practice, changes previous legislation behind practice, creates conditions for development and growth of rural credit guarantee institutions by legislation first and construction of standardized market environment.
