A Probe Into Justice In The Construction Of Government Accountability System During The Transformation Period

Since the occurrence of SARS incident in 2003, the word accountability has taken off in a big way in politics. Correspondingly, people's governments at various levels have formulated rules and regulations with regard to accountability however scattered and based on their respective situations. So far, China has not developed and recognized national unified government accountability system. This paper deals with how to construct government accountability system. It combines an old proposition'justice'with the construction of government accountability system and discusses how to realize earnest justice during the process of constructing government accountability system.Based on previous research, this paper first elaborates the basic principles of justice and government accountability system comprehensively, then analyzes the justice model taken by western countries and Hong Kong Government in the construction of government accountability system as well as the exemplifying function for china, and at last conceives the status of fair government accountability system in China it ought to be. This section defines that fairness in government accountability system, namely, research in the procedural fairness and substantial fairness.This paper further elaborates the major problems existing in building fair government accountability system in China and analyzes the progress and shortcomings as well as the reasons for the shortcomings, such as the ambiguous definition of elements of accountability, deficient legal system concerning accountability, absence of coercive power and the immature administrative environment during the transition.Finally, this paper tells the guiding ideology and basic principles we shall adhere to in building fair government accountability system. This paper puts forward some pertinent recommendations for improving the fairness, such as defining clearly and optimizing the accountability elements, clarifying government's accountability thinking; improving relevant laws and regulations, constructing the statutory basis for government thinking; improving the auxiliary system and operating mechanism so as to advance government accountability system and strengthening the awareness of responsibility so as to foster excellent administrative environment for the construction of government accountability system. In addition, this paper elaborates the importance and meaning of building a fair and perfect government accountability system and rests on building a perfect and harmonious society.
