Research On The Judicial Impeachment

Judicial justice is the eternal subject in the establishment of law and order in human history. The judges, as the main body of justice, play decisive roles in the realization of justice. However, with the economical development and the increasingly significant role of the justice in social change, a lot of misconduct of judges has been exposed, a lot of behavior we've used to is called into question, what's worse, some of them have affected the heart of the judicial system justice. Therefore, judicial impeachment is needed by the social development. In some western developed countries, the high quality of judges is required, the principal organization of judge appointment have much higher ranks, and the training and guarantee of judges have been attached great importance to. Despite the fact that different country has different characteristics and emphasis on the judicial impeachment, they all have relatively mature and sound ones. China has the relevant provisions of judicial impeachment however, stipulating which behavior of judges should be investigated is far from being enough, the understanding towards accountability should be changed, the redefining of the standard of liability is needed. Moreover, workable, transparent, fair and effective procedures for the system should be established so as to safeguard it. In view of this, the author of this paper tries to find out the important aspects of western judicial impeachment from which we can draw references through static analysis, research of practical application and comparative analysis between different systems in different Western countries under the rule of law. All the researches and analysis have important theoretical and practical significance for the judge to give full play to improve self-discipline, realize the value of litigation goals, and reshape judicial authority.
