Research On The System Of Police Administrative Assistance

During the process of modern administration, administrative subject often need to ask for help to the public security organs in order to complete administrative tasks, system of police administrative assistance came into being. Police administrative assistance system is established to provide support according to the law for achieving administrative functions when administrative subject with no affiliation to the public security organs encounters insurmountable obstacles in the course of performing their duties and requests assistance. Police administrative assistance system is not only related to the implementation of specific administrative conduct, but also plays an important role on unity and efficiency of public administration. Police administrative assistance system is the significant content in the field of police organic law and police procedural law. Some extraterritorial countries provide general items of administrative assistance in the administrative procedure act. Special provisions about police administrative assistance which avoid the police authority intervention in non-police activities excessively exist in the administrative enforcement law, administrative execution law and police law. Legal system in China has no unified legislation about police administration assistance, it can be found in different laws and regulations. Police administration assistance system is stipulated according to different issues, different situations and different areas. However, the imperfections of administrative procedural law and administrative organic law make the police administrative assistance too general to be of much use. As opposed to the institution drawback, police administrative assistance is very common in administrative practice. The contradiction between theory and practice requires us to build a perfect system of police administrative assistance. Therefore, this thesis tries to analyze current situation of police administrative assistance on the basis of basic theory and put forward measures to consummate police administrative assistance. This thesis is divided into five chapters:The first chapter is the basic theory of police administrative assistance which contains analysis of concept, characteristics, classification, system functions and theoretical foundation. The second chapter expounds development status from legislative and practical point of view. The third chapter is the general situation of police administrative assistance in foreign country from which our country can learn the experience. The fourth chapter is the basic principles on which police administrative assistance is based. The fifth chapter put forward the way to solve the problems of current police administrative assistance system. Procedures, supervision mechanism, responsibility sharing, legal remedies of police administrative assistance is expected to be further improved.
