Operation Review And Standardization Conception Of Police Administrative Assistance In China

Police administrative assistance is an action that the public security organ,based on the request of other administrative subjects having no affiliation with it,and due to lack of authority of the requesting subject or other legitimate official reasons,provides relevant assistance within the scope of police administrative authority in accordance with the law,to achieve the administrative purpose of the requesting subject.Police administrative assistance is widely used for its many advantages.Due to insufficient legislation and defects in the management system,police administrative assistance has become increasingly generalized,resulting in a series of problems such as the normal work of public security organs being affected.In view of this,the author combines standard construction,local practice,extra-territorial legislation and other conditions of the police administrative assistance,to seek theoretically and practically feasible measures,and to have a conception of standardizing and improving Chinese administrative assistance systemThis thesis includes four chapters:Chapter 1 is the theoretical basis of police administrative assistance.It comprehensively analyzes police administrative assistance through concept interpretation,characteristics analysis,comparison of relevant administrative actions,and type classification.Chapter2 is the analysis of the current operation situation of police administrative assistance in China.By enumerating and comparing relevant standards,it reveals the shortcomings of Chinese police administrative regulations.And based on the establishment and the operation of administrative assistance system in Xiamen,it comprehensively analyzes,summarizes and concludes the status quo,problems and causes of current administrative assistance in ChinaChapter3 is the investigation of extraterritorial police administrative assistance system.By introducing mainly the process of relevant legislations from Germany,South Korea and other countries and Taiwan in China,and combining Chinese national conditions,it summarizes the practices that can be used for reference.Chapter4 is the conception for standardizing and improving the police administrative assistance in China.Firstly,it looks forward to the prospect of police administrative assistance with the background of social development.Secondly,it clarifies the basic principles to be followed and the selection of legislation mode for police administrative assistance in China.And finally,by combining theory with administrative practice,it puts forward seven feasible suggestions for improving police administrative assistance.
