Study On Current Status And Countermeasures Of The Medical Disputes In Hongkou District, Shanghai

BackgroundMedical dispute escalated into effect a major focus and was to be a problem in harmonious society. Research showed that since the "Medical Malpractice Treatment" was enacted from 2002,the occurrence of medical disputes has surged, and the violent events level has increased. So, the research on medical dispute resolution would be a significant on the following aspects:to establish and maintain the good relationship between doctor and patient, to maintain the legitimate rights between doctors and patients, to promote the development of medicine and to build a harmonious society.ObjectivesThrough the research on the medical disputes handing of Hongkou District, Shanghai and exploring the main obstacles of medical malpractice and accident in handing, to improve the basic ideas for handing medical disputes.MethodsQualitative and quantitative methods were used in collecting and analysis data of medical disputes, administrative processing, administrative punishment which Hongkou medical malpractice handing office collected. Also expert interviews and a questionnaire survey were used to explore the causes and countermeasures which showed great difficult to resolve medical disputes.Results1.The number of medical complaints from health administrative departments firstly increased and then decreased.2.The departments of surgical, medical and gynecological were the high incidence of medical disputes.3.The unsatisfactory quality of healthcare is the main complaint cause of patient.4.The causes of the phenomenon which the malpractice number of cases first increased and then decreased in Direction of Health Administrative Departments were the justice and consultation' solution.5.The number of medical incidents decreased year by year, and was mainly qualitative way through legal channels.6.The total amount and the average of compensation from medical disputes increased significantly. And the main form of medical dispute resolution is consultation between doctors and patients.7.Omission of medical reporting on medical malpractice and disputes is serious.8.The phenomena of visit downtown in medical disputes were growing.Recommendations 1.To improve the laws and regulations in medical disputes related.2.To establish the third-party medical dispute mediation mechanism.3.To improve the Medical Malpractice System.4. To strengthen the medical safety monitoring, and establish the warning mechanism.5. To promote and improve the medical liability insurance.
