The Research On Perfect Of Legal System Of Supervision Of Financial Leasing

The financial leasing introduced in our country in 1982 has become maturity from infancy. It has played the vital role in the national economic development-he proportion of leasing close to 1% in GDP. However, there is enormous gap between the developed country and our country. In developed country, the financial leasing was known as the "second largest financial tools". Legal, accounting, tax and regulation are the four pillars for the healthy development of financial leasing industry. This paper focuses on supervision of financial leasing in China's legal system, analyses the problems of supervision in our financial leasing. Basing on absorption, digestion, drawing on foreign experience successful regulatory, combining the conditions of our country, the article aims to find proper way to the bottleneck of our country's financing industry that facing in the development.This article is divided three chapters and altogether is five parts in addition introductory remarks and conclusion. In the first part, the article differentiates the financial supervision and the financial leasing supervision, and points out that the financial leasing supervision has its special way. Because the promotional function of financial leasing is more and more prominent, its regulation become complex and special.In part two, the article presents in which positions and reasons of the supervising and managing law system of financial leasing in China. It analyses the main reasons for the existing barriers and the problems of the financial leasing supervision which shows that the regulatory vacuum and cross-regulation resulting from the financial innovation call for solution. We should reconstruction the uniform and moderate rules in financial leasing supervision.Chapter three is the reflection on improving and refining the financial leasing legislation in China. Based on the practice and the problems found, it provides concrete solutions to perfect our financial leasing legislation regarding many core and crucial problems of financial leasing, such as legislation models, legal properties of financial leasing. This chapter also mainly introduces and explains the Financial Leasing Law of P.R.C. which is currently drafted in and the construction of the entire legislation system of financial leasing in China.
