The Legal Research On The Circulation Of Contractual Operation Right Of Rural Land

Law of the people's republic of China on the contracting of rural land and Law of the people's republic of China on property right have been put into practice. It built a base for the circulation of the right to land contractual management. The right to land contractual management rights as a property right, it is necessary and realistic for its circulation. However, there are stringent constraints for the circulation of the right to land contractual management, the conservative and delayed of Legal theory and legislation practice to restrict the practice of land contracting right development.So, This article form the definition of the circulation of the right to land contractual management, analyze the land contracting right legal basis as well as legislative changes, which to lay a theoretical foundation of the right of rural land contracting deficiencies. Meanwhile, research and analyze the emphyteusis system in our history and foreign land system, absorb their reasonable approaches, provide comparative theory to improve the rural contract land circulation. Then study on the legal way and practice ways of the circulation of rural land contracting right, analyze the development of the level of legislation and practice and provide specific measures of improvement Finally, the article put forward some tentative suggestions to build supporting systems of China's rural land contracting right, hoping to contribute a little to further improve rural land circulation system of our country.
