Analysis On The Labor Standard Under New Trade Protectionism

With the development of world economy, the international labor standard becomes more and more important. In international trade negotiation, this problem has becoming a new implacable contradiction between the developed country and the developing country. The developed countries consist that in order to protect the labor right the "society clause" should be listed in WTO clause. And they also thought that the labor standard should be connect with the international trade, those countries who don't observe the international labor standard, international community have rights to give them trade sanction. While the majority of developing countries fight against with labor standard links up with international trade. Because there are various interests in the international community, the labor standard problem brought into the WTO multilateral trading system is an inevitable trend. As one of the most important developing country, China owns magnanimous cheap labor like other developing countries. For this reason, in international trade China usually suffered trade sanction by the developed countries. So studying the international labor standard is very important to China.In this thesis I have adopted various research methods such as utilization analysis method, compared analysis method and so on. And I also analyze the labor standard by the political economics.with a view to grasp the international labor standard much bettering order to provide law measures to China and extensive developing countries.The structure of this thesis divided into three parts:introduction, text and concluding.The introduction mainly introduced the studying background, studying significance, research methods of this thesis and so on.The first chapter is mainly about the effect and characteristic of the new trade protectionism, then introduce the concept of the international labor standard.In the second chapter, there are some views of the developed and developing countries about international labor standard problem. First, this part analyzed the origin of the labor standard, then analyzed the focal point of the argument, after that I analyzed the essence of the labor standard, and then analyzed the essence of this argument. The third chapter analyzed the relation of international trade and labor standard. First, I analyzed the viewpoint which was insisted on by the developed countries, and then analyzed the developing countries viewpoint. The core of this part is to point out the proper measure to connect the international trade and international labor standard.The fourth chapter is also the main body of this paper; it is about how to improve the labor standard appropriately. First, the author thought that we should make full use of the international organizations in order to put the course of trade freedom; secondly, the author thought that the developed countries ought to do more efforts, at last on improving the labor standard, I give the developing countries some useful advise.The fifth chapter is about the labor standard problem of China, China is also confronted with labor standard in international trade, the first part is about China's basic position on international labor standard and contribution, secondly analyzed the problems which China is confronting with, at last I give some advise on how to put the labor standard into practice and how to improve our country's labor standard.The final part is the concluding of this paper, it is the summarization and summary of this paper.
