Study On Fuzzy Language In Marriage Law By Multi-perspective

Fuzzy is broadly existed in legal language and it's also one of the most important contents of legal language research.To study the fuzzy language in law more deeply based on provedness, this paper used marriage law's legal provisions as carpus, Combining with the judicial interpretation, taking contrastive method to extract the fuzzy language which have been interpretaed in judicial interpretation of the marriage law provisions, summarizing the components of the structure of these fuzzy language. the aim is to research the distribution, characteristics, and precision of the fuzzy in legal language.In Chapterâ…¢,we researched the features of fuzzy by the view of syntax, cognitive psychology and logic semantic.From the perspective of cognitive psychology, the paper distinguished the declarative elements, procedural elements and commentitive elements of fuzzy language. From the point of logical and semantic,the paper distinguished the concept of programmed fuzzy elements and fuzzy elements in conditional combinationIn Chapter IV, we discussed about the characteristics of fuzzy language and the advantages and disadvantages of fuzzy and summarized some typical types of the fuzzy language:the first type is benificial objectively and is used purposefully, the second type is harmful and it is caused negligently, the third type is harmful but it is difficult to eliminate.The rusult is heipful to explore new methords to eliminate fuzziness targetedly.In chapter V, comparing judicial interpretation with marriage law, the paper summarized the way of precising the fuzzy in the judicial interpretation. At the same time we also studied the three cases which should avoid using fuzzy language:avoid fuzziness when stating the main subject;avoid fuzziness when identifing the force of law and avoid fuzziness when regulate the limitation of actions.
