Analysis On Animal Rights Jurisprudence

The relationship between people and animals is an age-old question. Viewpoints on animal rights vary from culture to culture. In modern society, with the rapid development of economy and substantial increase of population, the competition of natural resources becomes more and more fierce and the human environment is worsening. All of these changes demand us to rethink the relationship between people and animals. This thesis tries to make a positive analysis on this problem from the perspective of the theory and practice of law.The first part concerns the controversy of animal rights. First, we give a brief introduction of animal rights. Then, we expound the pros and cons of animal rights and try to find some inspiration for our study from their consistency in order to promote the development of Wildlife Protection Act and Animal Welfare Law in China.The second part deals with the theoretical basis and value of animal rights. From three aspects, that is, natural rights, moral rights, and legal rights, this chapter introduces the theoretical basis and value of animal rights, with the aim at seeking some efficient ways of making theories concerning animal rights become the specific stature.The third part focuses on the value and reshaping of animal rights in China. Through accounting for the specific regulations and the ideas of legislation of the current animal rights in China, we try to emancipate the human-centered mind and to reconstruct the legislative ideas of the law of animal rights protection in China.The fourth part is a reconstruction of the law of animal rights protection in China. In this chapter, we analyze the problems existing in the current law of animal rights protection in China and offer some suggestions on how to reconstruct and perfect the law of animal rights protection in China.Through the above analysis and comparison, we try to offer some suggestions for the law of animal rights protection in China.
