The Investigation Of Animal Protection Legislation In China

To protect animals by legal ways has become a consensus ofcontemporary society. In other countries, especially in occidentalcountries, the legislative practice of animal protection has nearly 200-yearhistory, and their animal protection system has been increasinglyimproved and achieved distinguished effects. Compared with theseoccidental countries, the process of China's animal protection legislationstarted rather late, the system of animal protection law is not perfect yetin our country. As a result, the current situation of animal protection isnot satisfied for our days. Therefore, it's necessary to analyze problemsexisting in the area of animal protection legislation, then to make somesound suggestions in order to improve the current situation of animalprotection in China. Focused in the perspective of "The law System ofanimal protection ", this article has made a preliminary study in China'sanimal protection legislation, through standardized analysis method,positive analysis method and logical analysis method.First of all, the author analyzed the necessity of effective animalprotection legislation in China in defining the concept of animal premise.Secondly, based on practice of China's animal protection, the authorevaluated animal protection legislation practice of foreign countries inorder to discover real problems existing in domestic animal protectionpractice in the direction of accelerating the process of animal protectionlegislation. Finally, the author analyzed some principles of the wildanimal protection legislation, and put forward some correspondinglegislative proposals on the basis of trends of animal protectionlegislation, hoping that the proposals may be helpful for China's animalprotection legislation achievement, and the suggestions will promote thedevelopment of animal protection in China.
