Research On Alternative System To Environmental Dispute Resolution

The 21st century, science and technology has achieved rapid development, economic boom has been realized, people's living standard has been greatly improved, so it seems like everything is so good, however, everything has two sides, the rapid development of productivity has brought negative spin-off products "environmental problems" to human society, at the same time ,environmental problems of increasing has inevitably brought a large quantity of environmental disputes, the processing of environmental dispute directly related to the people's interests, social harmony and stability of the country. Therefore, for the construction of harmonious society, how to deal with the increasing environmental disputes have important significance. Say to the processing of environmental dispute, we must face the environmental dispute solution, but in fact, the dispute settlement system of China is very simple, and there exist such the plight of over-reliance on lawsuit, therefore, the research of this article to alternative system to environmental dispute resolution has important significance. Our country is in the stage of the gradual deepening idea of rule and the gradual deepening idea of people's rights, also, the final judicial authority is gradually strengthened. Meanwhile, more and more environmental dispute started out of self-reliance, folk of dispute solution to lawsuit, however, owing to the limited number of judges and the lack of environmental professional knowledge, the court couldn't cope with plenty of environmental disputes. Because of seeing the drawback of lawsuit, many western countries have the judicial reform, so, the research of ADR come into the attention of the judicial reform. We should comply with this trend, speed up the study of the Alternative Dispute Resolution, and provide alternative choice for the treatment of environmental disputes.The theme of this paper is the Alternative Dispute Resolution. This paper is divided into four parts; the first part is the outline of environmental disputes, mainly introduce the concept, types and characteristics of environmental disputes, next, discuss the causes of environmental disputes. The second part is that study environmental disputes and alternative dispute resolution. In this section, above all, introduce alternative dispute resolution. Next, introduce alternative system to environmental dispute resolution. The third part is that discuss the current situation and drawback of alternative system to environmental dispute resolution of China. The fourth part is advises and measures of perfecting the alternative system to environmental dispute resolution.
