In view of the impact of the financial crisis, coupled with the internal problems in the operation of aviation industry, the global aviation industry is facing with many difficulties, China's airlines are facing enormous impact. In the new situation of competition at home and abroad, it is the the strategic foundation to cultivate the power of core competition actively which can adapt to a dynamic environment for China's civil aviation in the "Eleventh Five-Year". The differences has important significance for China's airlines on competition, but there are still many legal obstacles, we should read the differentiation of China's airlines under the premise of analyzing these obstacles. In fact, the problem of diseconomies of the scale is especially acute in China's airlines. We will face many obstacles to achieve the objective of differentiated strategy on competition in the group of airline alliances, large-scale and group-oriented for major countries on aviation. These obstacles include renew of concept, design of content, implementation of legal system and evaluation of effects. Whereby the legal responses for differentiated competition in China's airlines can start from the macro, meso and micro levels:the macro-legal response for differentiated competition in China airlines can be divided into the government's macro-control-oriented as well as the remodeling for functions of regulatory department in aviation industry; the meso-legal response for differentiated competition in China airlines can be divided into demands from the power of core competition, optimization of objective, construction of system and coordination of interests; the micro-legal response for differentiated competition in China airlines can be divided into change for the mode of economic growth, legal innovative mechanisms for the management of airlines, legal system of industry self-discipline, self-help and self-control, market positioning and establishment of advantage on differentiated competition, development and the regulatory of airline's strategic alliance, legal mechanisms of evaluation for the results of differentiated competition. This dissertation is composed of four major parts as follows:Part one deals with the current status of China's airlines. This section analyzes the current difficulties of global aviation from the financial risk, energy markets, international and domestic development of economy and society. It attributes the situation of competition in our country to competition between domestic airlines, international and domestic airlines, as well as the international living environment for China's airlines. Part two deals with the substance and the direction in the future of airline industry. This section focuses on the particularity of the aviation industry, discusses the architecture of system for airlines and analyzes the characteristics of network economics which the development of aviation industry in the future must be based on. We should explore concept and update system in the premise of respecting the characteristics. It also explains the liberalization of aviation industry and the large-scale trend for airlines in the future in detail.Part three deals with the differentiation of competition and it's legal obstacles for China's airlines. As one kind of systems, the differences has important significance for China's airlines on competition, in fact, the problem of diseconomies of the scale is especially acute in China's airlines currently. We will face many obstacles to achieve the objective of differentiated strategy on competition in the group of airline alliances, large-scale and group-oriented for major countries on aviation. These obstacles include: path-dependent is the obstacle for renewing of concept on legal system of differentiated competition, market structure of aviation is the obstacle for designing of content on legal system of differentiated competition, business model of airlines is the obstacle for implementation of system on legal system of differentiated competition, regulation of aviation market is the obstacle for evaluation of results on legal system of differentiated competition.Part four deals with the legal responses in differentiated competition for China's airlines.
