On The Legal Regulation Of Village Bank

In order to solve the difficulties in countryside financing which is the bottleneck of the "Three-Agriculture" construction, from the end of 2006, some Village Banks have been experimentally established in some provinces then spread across the country. As one of the new type of rural financial institutions, because of the imperfect financial legal system, the Village Bank faces a lot of difficulties in its starting and developing phases and its financial support to the "Three-Agriculture" is also less than satisfactory. This thesis just focuses in two research emphases which relate to the development of Village Bank and its financial support to the "Three-Agriculture". The author analyses the crux of the problems and tries to provide institutional arrangements at the legal level so as to promote the development of the Village Bank and maximize the effect of its financial support to the "Three-Agriculture".This thesis is composed of following five parts.The first chapter is the introduction. It summarizes the background about establishing Village Bank and related existing laws and regulations, and it points out the meanings of this study which is to design a institutional framework for Village Bank at the legal level clarifying the aim of this design work is to encourage the development of Village Bank and its financial support to the "Three-Agriculture".The second chapter is the investigation of the rural financial market and the operation situation of Village Bank. First it studies the mismatches in supply and demand in rural financial market. Then, it gives an observation about the operation situation of the Village Bank summarizing the features of the Village Bank system which fits for the rural financial needs, for further study.The third chapter is analysis of Village Bank legal issues. It summarizes laws and regulations, gives an overall analysis about four principal problems of Village Bank at the legal level. Then, it discusses the shortcomings of the constitution which is acting on the development of Village Bank clarifying the direction and keynote to which the legislator should pay attention.The fourth chapter is introduction of the foreign legislation about Village Bank. It mainly introduces the state of development and legislation of Village Bank in Bangladesh and the United States. Then it summarizes the foreign legislation in order to help our legislation on Village Bank. The fifth chapter is the legislative proposal. It first puts forward the guiding legislative ideology which we should follow in our Village Bank legislation. Then, it gives answers to the questions which have been presented in the third chapter by legal way. In addition, it makes some legal institutional innovation with the purpose of developing Village Bank and supporting the rural finance.
