National self-determination is the Production of anti-colonial revolution. The concept of national self-determination expresses the idea of democracy, freedom,equality and human rights. The concept of National self-determination had spread widely with the development of capitalism in Europe in the middle of the 19th century. It was particularly elaborated by Vladimir Lenin, Woodrow Wilson and Franklin Roosevelt. Under the influence of national self-determination, the colonial system collapsed in the surging tide of national independence and liberation in Asia, Africa and Latin America. International law also recognizes the right of national self-determination.Today, most of the sovereignties recognize the right of national self-determination.But the right of national self-determination has been used by national separatism by mistake since the end of Cold War. And the separatism threatens the peace and stabilization of the whole world.Recently, the independence of Kosovo and South Ossetia brought huge damage to the international environment and international law. From the Kosovo's declaration of independence by support of USA and UN,to the Russia's recognition of South Ossetia and Abkhazia, the idea used by is national self-determination.The national self-determination right, as a basic principle of modern international law, is limited by international law and national sovereignty. And this right cannot be the struggle tool between great nations or the thesis used by national separatism to destroy the territorial integrity and sovereignty.The purpose of thesis is to discuss the history and development of the thought about national self-determination, national self-determination in international law, the problem caused by Kosovo and South Ossetia, the concept of national self-determination, and its relationship with state sovereignty and separatism, restrictive factor of national self-determination.With the combination of theory analyses and practical case, the thesis aims to give scientific and comprehensive study.
