Comparison Between Private Education Promotion Law In China And Private School Law In Japan

Japan always takes seriously to the legislative work of education, we have similar cultural tradition, and both countries are the civil law system with statute primarily. Japan's education law praises for the world, not only its quantity is huge, but also the rigorous structure and form standard. The Private School Law in Japan was enacted in 1949, and it has been revised in 2007 recently. The Private Education Promotion Law in China was enacted in 2003. All of them are described as"the basic laws"in the private educational jurisprudence of two countries. The Private School Law has been revised for more than 20 times. It has become increasingly perfectly. Many places are worth for our using. So, author locates its research object of the study in the Private Education Promotion Law in China and the Private School Law in Japan. Based on a comparison between the Private Education Promotion Law and the Private School Law in Japan, analyze the difference between the two laws in the legislative background, content and results.This article uses George Bereday's comparative method----four stages of analysis (description, explanation, juxtaposition and comparison).At first, we start up the collection of private education law for China and Japan. We arrange the materials, and then explanation. The explanation is focused on principle points. Finally, we listed the differences between China and Japan and try to indicate the valuable information for our country.To sum up, with the transformation of people's thoughts, private education has become the important position of auxiliary part now. But in our country there are some problems have to solve yet. Japan's private education supervision system, management, revision and feature of legislation have a profound inspiration for the healthy development of private education in China...
