Analysis On The Improvement Of Administrative Inspection System China

Administrative inspection, an important way of maintaining orders and performing functions carried out by administrative bodies, is one of the administrative managements applied widely in China. Meanwhile, as an intervenient action, if an administrative inspection lacks of special authorization and program constraint, it will very likely violate the legal rights of administrative relatives. Many social cases and current events have already confirmed the urgency and importance of improving the administrative inspection system. In contrast to the pervasive implementation of administrative inspection in administrative management practice, the study on administrative inspection is still weak and out of date in academia.In this thesis, the writer focuses on the legal nature of administrative inspection and through the analysis on the distinctions among parallel concepts such as administrative inspection, administrative investigation and administrative supervision, proves that administrative inspection is self-reliant not subsidiary, an administrative legal act, instead of an administrative behavior. According to the actuality of administrative inspection in culture market and other fields, the text points out the main problems of current administrative inspection in China: the right of administrative inspection without concrete authorization, the random start-up of administrative inspection, the limits of authority of administrative inspection , the lack of means of administrative inspection, the unjustified intention of administrative inspection and blocked relief approach of illegal administrative inspection, etc. To solve the problems above, this thesis suggests, by introducing a series of regulations and documents on administrative inspection elaborated by current regional governments, to improve Chinese administrative inspection system by standardization of administrative inspection in the following four aspects: authorization of right, limits of authority, implementation procedure and relief approach.
