On The Legal Remedy For Administrative Inspection Behavior Of China

As one of the important administrative management behaviors in our country, administrative inspection behavior widely applied in areas such as industrial&commerce, customs, quality inspection, health epidemic prevention, etc. As an intervention behavior, lacking of special authorization and proceeding control, an administrative inspection behavior is likely to violate the legal rights of administrative counterparts. Many social events happened recently have fully testified that the illegal and improper administrative inspection behaviors could cause damages to the legal rights of our society and people, and emphasized the necessity and importance of legal remedy for the illegal and improper administrative inspection behaviors. However, the study on legal remedy for administrative inspection behavior is still week and out of date in academia.Chapter One of this article introduces the basic theory of the legal remedy for administrative inspection behavior, mainly includes the concept of administrative inspection, the basic meaning of legal remedy for administrative inspection behavior, and the necessity of legal remedy for administrative inspection behavior.Chapter Two is the introduction of the current legal remedy system for administrative inspection behavior of China. This article elaborates the basic condition of our current legal remedy system for administrative inspection behavior from two aspects: administrative remedy and legal remedy, and indicates the weakness of our legal remedy system for administrative inspection behavior.Chapter Three provides a brief survey of the legal remedy system for administrative inspection behavior in the United States, Japan and Germany. Then suggestions are produced to improve our legal remedy system for administrative inspection behavior.Chapter Four concentrates on the restructure of legal remedy system for administrative inspection behavior of China. The specific corresponding legal remedy measures to different types of administrative inspection behaviors are clarified, and suggestions are made on the improvement of legal remedy for administrative inspection in aspects of administrative reconsideration, administrative proceedings and administrative compensation.
