Research On Juvenile Criminal Procedure

The juveniles are the future of the country, the hope of the nation. With the gradual increase of the juvenile criminals, the jeopardousness is listed along with"drug criminal"and"environment pollution". How to prevent and cure the juvenile criminal has attracted much attention globally. Moreover, this reflects the integrity of the national criminal procedure law. Actully, many countries have put much efforts in this perspective.The United Nations has made a series of regulations concerning the protection of juveniles, for example < Standard Minimum Rules for the Administration of Juvenile Justice >,< Rules for the Protection of Juveniles Deprived of their Liberty>,< The Prevention of Juvenile Delinquency Guidelines >.Taken a view on the juvenile criminal procedure law system in our country, we disclosed that the system is far from a developed one. Although we have enacted < Juvenile Protection Law> and < Prevention of Juvenile Delinquency > etc., we protect the litigation rights of the juvenile only, to some extent, staying on the principle of the paperwork. produces some material regulations though, such as the presence of the representative, non-public trial and appointment of defendant,the system as a whole has not been formulated. The explanation enacted by the Supreme Court thereafter as supplementary cannot fundamentally change the status of the protection of the litigation rights of the juvenile criminals.This article will cut through the concept of the juvenile and the characteristics of the crime committed by the juveniles,comparing the domestic litigation pattern of the juvenile with the system in other countries so as to present the principle, the basic elements and the concrete system. This article will also give some thoughts on the current status of our legal system in order to provide some useful reference on optimizing of the protection of the juvenile criminal.
