Narrative Methodology In Judgment

The perspective of this dissertation for academic degree is:Written judgment is compose by court of justice using jurisdiction, that is to say, Written judgment is not automatically generated but created by court of justice for persuading parties and others.So, it must take the narrative mode and readers'acceptance into account. Meanwhile,Narrative methodology is method and reader's acceptance is purpose.So, narrative methodology in judgment is having rules to follow. The dissertation revealed that language in written judgment is in the form of a soliloquy,so the narrative is constructive first, and then analysis and conclusion. That is to say, facts of a case are Existing without constructive, at least,the facts that judicature context on and as the basis of judgment is not found, but produced in judicial process, or to say, constructed.As the above said, the objective of judgment is to persuade parties and others.it is a long way for the message delivered from message source to audiences, how this influences court of justice to narrative? For the sake of effective transmission, or to highlight some facts of the case, court of justice tailor objective facts inevitably, adding emotive tendency language without trace in the written judgments which seem to be fair. All in all,narrative methodology is to serve judgments'convincing objective, and what decides narrative methodology is reason and experience in judgment constructing.
