Study On Legal System Of Public Utility Price-controlling Of Our Country

Having experienced 10 years of market economic reforms, there are a lot of aspects which are not suited with the aims of Chinese public utilities in the price regulation. The reason mainly rests with that the legal system of price-controlling is not perfect. The thesis is based on the special context that public utility is a specific control objective in Chinese market. Through checking the theory research and institution-building of price-controlling of public utilities in the developed countries, I have analyzed various problems which exist in Chinese current public utilities price-controlling system, and attempted to give some suggestion for improving the legal system of price-controlling in our public utilities.The thesis is divided into six parts, which include the introduction and conclusion.In the introduction, the thesis has expatiated the current domestic and foreign research situation about the price-controlling on public utilities, and pointed out that there is the necessity of building the legal system for our price-controlling in our public utilities, and put forward the studying methods, purposes and significances.In the first part, the thesis has analyzed the needs of price-controlling from the specific attributes of public utilities.In the second part, the thesis has checked the practice of building legal system in price regulation in the developed countries, and analyzed the development trend of price-controlling in public utilities, and elicited some valuable enlightenment.In the third part, I have discussed the history and status quo of Chinese price-controlling in public utilities, and assessed the current legal system of price-controlling in public utilities. Then, I point out that there are some problems in price-regulating principle, price-forming process, regulation organs system, price structure, form of price and price management system etc.In part IV, In order to deal with the problems about legal system of price-controlling I have proposed in part iii, I bring forward some imagination for building legal system of price-controlling and demonstrate it detailed. I think, if we want to build a ideal legal system for price-controlling, we must do our best as follows: Firstly, we ought to frame a kind of complete price-making principle. Secondly, we must devise a price-framing process which can reflect the interest claim of every party and which must be open, fair and just. Thirdly, we must establish a perfect mechanism which can control effectively the price of public utilities. Fourthly, we must adopt scientific price-formatting mechanism and price structure which can make public utilities not only meet the basic social needs, but also access to their own development. At the same time, we also need improve the cost supervision, price compensation system and incentive system etc.In the conclusion, I sum it up and prospect the role which economic law can play in building the public-utility-controlling legal system.
