The Fusion Between The Chinese Traditional Ethics And Modern Government By Law

The relationship between morality and law is an eternal topic,which ancient and modern scholars have repeatedly discussed. They are closely related and inseparable, And in many cases,they are complement and jointly promote the development of state and society. Whether moral or legal are historic, there is a process of development, for which we can not cut off history to be evaluated on both. This article study the relationship between the ancient Chinese tradition morality which has an important influence and the law.We want to build a bridge between law and morality,between tradition arid modernity.Of course,the relationship between them is not somebody's creativity and invention and we are just to find it.The purpose of the exploration and discovery is better for the development of law, and is also better for the tradition of the Chinese nation.This article is divided into six parts:the first part is the introduction, including a brief background of issues, significance, and the main content of this article; the second section is to introduce Chinese traditional ethics, including its meaning, the basic characteristics; the third part is to introduce the rule of law,including the meaning of the rule of law and it's limitation;the fourth part is the relationship between traditional morality and the rule of law, including its consistency and some problems; the fifth part is the amalgamation of the two, including the two co-exist necessary to create good laws in the integration and fostering the integration of people.Based on the reference to the literature and the information,the author state that we can not ignore the ethics,especially the significant role of traditional morality and that we must abandon the rule of law which impede the process of negative factors.
