The rural land system is the foundation of the system, rural land management not only related to the reform of the stability and development in rural areas, it also related to urban and rural land resource utilization. At this stage for the circulation of collective land, mainly concentrated in the collective construction land of administrative and economic terms, the former principal of land management, with mandatory but lacks flexibility, excessive administrative intervention will lead to market failure or market failure, resulting in a market on land resources allocation of disorder; the latter focuses on the theoretical basis from the economic area to establish the transfer of the market system, although they can afford to and market economic development practice, but because of the economic model is OK, idealized, in practice there are limitations for the economy is only a means, a lack of basic support, easily unstable.This paper is in related research and practice, on the basis of the clear collective land is currently China's rural collective land use system reform of inevitable trend, combined with the actual situation in China, from the legislative point of view, analysis, research methods, such as inductive analysis, on the basic categories of land transfer, theoretical basis, various land operation, as well as problems and causes, etc., for comparison system for induction, analysis, and research, and on the establishment and improvement of the land system proposed solutions:give farmers the long-term stability of land titles, on the basis of clear land property rights, to strengthen government management, the formation of diverse and efficient land use patterns.
