Study On China's Status Of Professional Sports Dispute Settlement Mechanism

China is a sporting nation that occupies an important position in the world. But our professional sports dispute resolution mechanism is relatively weak. This paper analyzes the loopholes which exist in our dispute settlement mechanism of Professional Sports. Referencing to the prevailing international dispute resolution, the author gives some ideas about constructing our professional sports dispute resolution mechanism. With these ideas, the author hopes our professional sports can have a good development, and can meet the progress of the professional sports'internationalization and globalization.The first part: The summary of professional sports. Firstly, the author compares the relevant concepts of professional sports. And then, clarifies one of the core concepts of this research, that is, professional sports. Secondly, the author analysis the characteristics of professional sports disputes, the classification of the professional sports disputes, the reasons which cause professional sports disputes, and the significance of professional sports dispute resolution.The second part: The basic approaches of professional sports dispute settlement mechanism. They are: sports negotiation or conciliation, the inner dispute resolution of the sports organizations, arbitration and mediation, and litigation. The third part: The other countries'experiences of professional sports dispute resolution. This section introduces the advanced experiences and the prevailing solutions of foreign countries which good at professional sports. From them, we can choose what we need.The fourth part: The current situation and existing problems of our professional sports dispute settlement mechanism. Though cases study method, this section introduces the typical cases in the field of professional sports in our country. Though the introduction, the author reveals the inadequacy exist in our professional sports dispute settlement mechanism, points out a better way to resolve those challenges.The fifth part: Some proposals for improvement. From the aspects of sports management and systems design as well as related legislation, the author gives some proposals to perfect the dispute settlement mechanism of professional sports.
