Research On The Labor Dispute Settlement Mechanism Of Chinese Professional Football

Labor dispute has been a hot topic in our country, and meanwhile it is also an important social issue which is related to the stability of social economy. Professional football labor dispute, as a special field of labor disputes, not only has the universal character of a general labor disputes, but also has its own peculiarities. After the twenty years development of professional football, even though China’s football career’s achievement has been improving, it is still far from the expectations of the majority of football fans, and is far from the developed countries’ achievement. The professional football labor dispute has its own specialty and particularity such as the specialty of the contradiction of the professional football labor relationship, national system strategy, market operation mode and inadequate legal theory research and so on. Thus the labor disputes frequently appeared in the field of professional football in our country.This paper is divided into four parts. The first part is a review of football career labor disputes. The groundwork of football career labor dispute theory is introduced by the analysis of the concept of occupation, football labor dispute types and characteristics. The second part is labor dispute settlement mechanism of football career labor dispute in the foreign sports industry in developed countries. On this basis of theoretical analysis of football career labor dispute, this paper learns the experience from the dispute settlement mechanism. The third part introduces the existing professional football labor dispute settlement mechanism, including internal consultation, arbitration of the China Football Association and judicial relief. Then this paper discusses the shortcomings existing settlement mechanism. The fourth part focuses on improving the labor dispute settlement mechanism of professional football including discussing the establishment of the sports arbitration system in China.In this paper, the author uses methods of the literature research, comparative analysis, logical analysis and induction, the empirical analysis to study the issue. On the status of labor disputes in the field of professional football, this paper analyzes the present situation of professional football labor dispute, and researches the problems and proposes feasible suggestions of it. Learning from the labor dispute resolution experience of professional football labor dispute in the European developed countries, this paper puts forward rationalization proposals for the labor dispute settlement mechanism to safeguard the legitimate rights and interests of Chinese professional players.
