Research On China's Outdoor Sports Insurance Based On Dispute Resolution Cases

In recent years,the state has paid more and more attention to outdoor sports.In January 2019,the National Sports General Administration jointly issued the Action Plan for Further Promoting Sports Consumption(2019-2020),focusing on supporting the development of leading fitness and leisure projects,promoting water sports,mountain sports,automobile and motorcycle sports,and bicycles.Such sports projects adopt the detailed implementation of development planning.Under the favorable development environment of national policies,outdoor sports have ushered in new opportunities for rapid development.Along with the growing popularity of outdoor sports consumer groups,as outdoor sports have the characteristics of relatively complex types of risks,outdoor sports safety accidents have gradually increased,and there have been more and more outdoor sports disputes.For the outdoor sports with more complex risk factors,the problem of outdoor sports insurance is not optimistic.In addition,the majority of outdoor sports enthusiasts do not know much about outdoor sports insurance,and there are even many blind spots.With the above problems intensifying,the development of fitness and leisure consumption in China and the space for sports consumption will be further affected.This study takes outdoor sports insurance as the research object,mainly through the literature data method,case analysis method and expert interview method.The study analyzes the outdoor sports disputes by analyzing the relevant judicial cases of three major types of tourism accident insurance,travel agency liability insurance and public liability insurance.The study focus on the dispute points in the case,summarizing the judgments of the courts,and exposing the main problems of outdoor sports insurance in the form of legal analysis.Based on the main problems existing in China's outdoor sports insurance,we try to clarify the important relationship between the outdoor sports stakeholders,and provide reasonable support for the further improvement of China's outdoor sports insurance and promote the comprehensive,healthy and sustainable development of the outdoor sports industry.The main conclusions of this study are as follows: First,the current domestic outdoor sports insurance presents a relatively single type of insurance,the insurance terms are rough,and the risk level and management services are general.Second,the current domestic sports insurance system has been completed,but the outdoor sports insurance system has not yet been completed.The outdoor sports interest groups such as leisure outdoor sports event organizers,outdoor sports venues,and leisure outdoor sports enthusiasts are still lacking in systematization and precision.Personalized sports risk solutions and management services.Third,outdoor sports organizers,outdoor sports participants,outdoor sports squatters,and outdoor sports marginal interest groups have their own independent closed state,failing to form a more benign interaction.
