The Issue Of Law In The Governmental Management Of The Schools Run By The Local People

The schools run by the local people meet many problems in the development. There are quite a few needed to be discussed from the law level. Based on forerunners and others research, this study focuses on the problems of preparation to establish, application, circulation and reasonable repayment of the schools run by the local people. Meanwhile, analyses the governmental management from the angle of law, displays a real picture of the existence and development of the schools run by the local people to the world, and thus as a reference for the local government to establish suitable policies and detailed regulations for the schools run by the local people.On the legal issues of the preparation and application to establish the schools, this thesis emphasizes to study the legal procedures of holders of the schools run by the local people and the schools that public schools participate to run. On the legal problems of circulation, the thesis mainly analyses the board of directors, enrollment and teachers' rights protection in the schools run by the local people. On the legal issues of reasonable repayment, the thesis studies from the angle of how to obtain reasonable repayment. During the investigation, the present author finds that the government exists "offside" and "absence from duty" phenomena and this hinders the development of the schools run by the local people to some extent.This thesis adopts the analytical method of case study, interview and legal theories. The present author selects Wenling Municipal governmental management of the schools run by the local people as a case, investigates and interviews part of governors and holders of the kindergartens, primary schools, middle schools, high schools and vocational schools run by the local people. Some officials provide me detailed information, which enriches the study. The present author collects the materials mainly through interview and documentation method.The thesis has four parts. The first part is general introduction, mainly introducing the topic definition, the research origin, studying meaning and research methods; the second part discusses the legal issues of the application and preparation to establish the schools run by the local people. The third part studies the legal issues of circulation of the schools run by the local people; the fourth part analyzes the other problems found in the investigation but not mentioned in the former parts.
