The right of rest, means that the primary and secondary students, during their growth process, fully enjoy the rest, activities and entertainment rights for their development. When discussing the right of rest, Many scholars, consider it as the subsidiary of labor rights, thus it leads to a neglected state for primary and secondary students sharing the right of rest."Dying of learning burdens" is not a professional legal terms, but can vividly describe violations of the right break for primary and secondary students currently. The thesis aims to answer the questions, such as what the current status of the students'rest rights, why the situation happened, How to eradicate the illness of exam-oriented educations in the short term, better protect the students'rest rights?The survey is via the questionnaire and interview method. the investigation areas involved in some counties from south of Henan Province, Huaibin, Gushi and Shangcheng. Surveying the middle and high school students in all grades and upper grades of elementary school students, schools were selected on the attention to urban-rural contrast. Mainly some of the teachers, the principals of some schools and some department heads in charge of education being interviewed aims to know the attitude of students and measures about the primary school students'rest right.This text consists of three chapters:The first chapter, research the current situation of students'rest rights in the south of Henan Province. In this section, mainly analyzes the direct impacts on the quality of rest among students based on the research, which Includes sleep time, making up classes on weekends and summer vacation, paid tutoring, homework, health aspects. Through the analysis of the survey data above, conclude that the current primary and secondary students'rest rights has not been effectively protected, even the extent of infringement is very serious.The second chapter, analyzes why primary and secondary students'rights can not be fully guaranteed. At the institutional level, mainly there is no clear definition of it; the lack of scientific work and rest in the school system's assessment; the lack of maneuverability on protecting the right of students to break; in the legal sense level, mainly due to the lack of rights awareness and effective means in the Rule of Law for department heads and teachers. The above analysis is mainly based on survey data and analysis on the interview results.The third chapter, is the recommendations to improve the legal system of primary and secondary students the right to rest. Include the following three aspects:first, perform the legal education, raise teachers and students sense of relevant law, in addition to rights awareness; Second, improve relevant laws and regulations; Third, improve the supervision mechanism and legal relief system. Above recommendations of the reason for the second chapter, combined with the current number of " dying of learning burdens ",obtained after a comprehensive analysis.
