Rights awareness guides rights behavior.With high level of their rights,parents will exercise their rights reasonably and participate in school education in an orderly manner,which could prevent abuse of power,safeguard students‘ rights,help to perfect the modern school system,and ultimately promote the overall development of students.This study explores the topic of parent‘s awareness of their rights in school education through literature research,interviews,and questionnaire surveys.At first,the educational rights of parents in school education can be divided into educational choices rights and educational participation rights.Educational participation rights can be further divided into the right to know,the right to supervise and the right to make decisions.The awareness of the rights of parents in school education can be divided into three aspects: First,the cognition of rights,which refers to the degree of cognition of the content educational choices rights and educational participation rights.The second is the claim of rights,which refers to the willingness to exercise educational choices rights and educational participation rights,willingness to defend their rights if the rights were violated and the attitude towards the rights of other stakeholders in school education.The third is the request of rights,which refers to the parents‘ awareness of appeal to the state or society to new rights.Secondly,according to the structure of parents‘ rights awareness,I designed the interview outline and questionnaire,and sample the parents and teachers of two compulsory education schools in Shanghai as the survey object,and investigated the status quo of parents‘ rights awareness in school education.The survey found that in terms of the cognition of rights,parents have not fully understood their rights in school education.They have the highest awareness of the right to know and supervise,followed by educational choice right,and finally the right to make decision.In terms of the claims of rights,parents have the strongest willingness to exercise their right to know,followed by their rights to supervise and educational choices rights,and finally the rights to make decision.Parents have a good sense of fulfilling obligations.They preferred to ask the government for help if someone violated their legal rights.And parents are most aware of respect people‘s rights.In terms of the request of rights,parents have consciously proposed new requests to the state and society,including the requirement to clarify the legal status of parent committees and to clarify the boundaries of parental rights and obligations in school education.Parent committee members and non-parent committee members,Shanghai local parents and migrant parents,parents with different qualifications have differences in rights cognition,claims and requests.Thirdly,this study analyzes the current status of rights awareness of parents.The reasons for this status includes the lack to relevant laws and regulations,the influence of traditional ideology and culture and the remaining problems of the planned economy,school and teachers‘ attitude toward parents‘ educational rights as well as parents‘ cultural level.However,the status quo of the family committee‘s rights awareness and rights practice are promising.Finally,in order to raise the awareness of parents‘ rights,this study proposed that the state should improve relevant laws and regulations requires,the government and schools should decentralize and guide parents to understand their rights.In the meantime,the role of social organizations,internet and news media are important,because they could provide legal education and consultation to parents.Also,parents‘ self-education should be considered as a way to enhance their level of awareness of rights and the ability to exercise their rights.
