With the rapid development of private higher education, corresponding problems highlighted, in particular, the absence of relevant laws and regulations of regulating private higher education make the key constraints of private higher education. In this paper, the relevant legislation for the private higher education study, analysis of the existing private higher education in the relevant legislation, comparative legislation better, the fastest growing private education legislation and regulations related to the U.S. position clear on a country's laws and regulations for private higher the development of education will have the most significant impact, especially for our country is in the early stage of development, the gap between the level of legislation directly determines the level of Private Higher Education in the gap. Ultimately exploring social and cultural background of the individual path of development efforts with a view to the improvement of relevant legislation, and the whole development of private higher education make a contribution.This paper is divided into four parts:The first part is a Sino-US status of private higher education comparative study of legislation, this section on the legislative status of Private Colleges and Universities combing, and the United States more complete legislative status of private schools compared to reveal the relevant legislation in Private Colleges and Universities The serious shortage of Private Colleges and attempted to improve the legal norms and legal system construction of the feasibility of proposals put forward.The second part discusses the legal status of private universities. In short, a good protection of the laws and regulations will be healthy and orderly development of private higher education and basic premise, in this road we still have long way to go, learn from the United States in comparison, the legislative experience of developed countries, private education, to explore for our society cultural background, personal path of development efforts.
