In the course of human history, the marriage is essential for a major activity. It is also because of its importance, the history of previous studies on this topic in the research process is indeed a lot. Beginning of the last century, the Folklore has been get rapid development, and the summarized results about marriage institution and marriage customs were already very rich. But due to various reasons, to further study from the differences between marriage law regime and the real situation of marriage, were very few. The reason for this state is mainly the complex and fragmented historical data, which makes the real history of marriage can not be fully grasped, and thus can not accurately sort out and study the relationship between the marriage legal systems and marriage customs of the Qing Dynasty.By reading a lot of historical documents, the author found that the relationship between the marriage institutions and marriage customs was of great significance. From the date of entry, the government of the Qing Dynasty has developed a series of ritual law relating to marriage regulations, and with the development of social history, in some content is also made some adjustments. Also in the law rules of mandatory guidelines, the marriage customs of the Qing Dynasty inherited all contents relating to marriage in history, continuing to enrich the civil marriage process of Qing. Ties and differences between legal systems of marriage and marriage customs became a major norm of marriage in Qing Dynasty, and under the common action, the marriage activity of Qing Dynasty are constantly enriched and developed whether it is in formal or content, at the same time, it had some impact on the formation of the modern marriage. But in the real social history, although the marriage law systems and marriage customs continuously from their point of view to regulate people’s marital behavior, the perverted form of marriage still exists. Through a lot of local history and the historical cases to analyze the relationship between marriage regimes and marriage customs, and thus to summarize the relationship between the real history and Ritual Law.The full text consists of five parts. The Introduction briefly instructed the basis of the subject, the study status quo of the topic, research content and methods. The second chapter summarized and combed on the Qing’s marriage law system. This part were summarized the basic condition of marriage law system before the Qing Dynasty, and the status quo of Qing’s marriage law system, as well as the basic overview of the marriage law system in Shanxi and Shaanxi. The third chapter combed and summarized the marriage customs of the Qing Dynasty. From the marriage form and marriage process, it further summarized the basic situation of the folk marriage in Qing Dynasty. The fourth chapter is a section which this article focuses on. On the basis of the first two chapters, Chapter IV summarized and analyzed the relationship between the marriage legal systems and marriage customs of the Qing Dynasty, from historical records to analyze the links and differences between them, and explained why there is a conflict between the two. The fifth chapter is the sublimation of this paper. It through the relationship between the marriage law regime and marriage customs, and the existence of the perverted form of marriage to further explore the relationship between norms and the real history of ritual law system.In short, marriage as an important activity of the Qing Dynasty, a real relationship with the provisions of the marriage because of often overlooked by people, there are still some issues that we need to further explore, discover and solve.
