Juvenile delinquency has always been a challenge for most countries, including China, in the world. With the rapid growth of economic and society, juvenile delinquency arose as a serious problem in China. Juvenile delinquency in China increased with some attributes, they are, the age of those youth offenders tend to be even younger, gang crime became a common form of juvenile delinquency, personnel involved in single cases increased, intelligence crime appear to be a new trend, and the diversification of criminal case types. School bullying can be an exact example. On-campus violence of teenagers and children has been reported frequently in recent years. These cases lead to a concern about teenager education. Adolescent abnormal behavior, a special type of juvenile delinquency, was identified by the author as "a harmful behavior beyond the reach of the concept of crime stated in Criminal Law in China". In addition, the bullying case of Chinese high school students in the United State of America brought up the discussion about the lag of Chinese legislation system. Indeed, the legislation of juvenile delinquency in China just began in a few decades ago. The author believes that to handle the juvenile delinquency problem, a suitable penalty system should be built up. With such a system, juvenile delinquency should be isolated from adult crime. Concept of crime should be applied to juvenile delinquency include crimes stated in Criminal Law, conditional non-prosecution crimes, and adolescent abnormal behavior. The penalty of juvenile delinquency should be positive prevention means instead of negative afterward punishment. Education should the priority of dealing with juvenile delinquents with the principle of "educate them, change them, and save them", and using punishment as an assistance. A penalty system with non-penalty treatment,which is characterized as applying protection treatment as main tool with the assistant of penalty, should be organized and eliminate the effect of labelling and cross infection; therefore, help the juvenile delinquents back to normal life soon with a lower probability of re-offending.
