In China, the pacts can be described as historic. Currently, the survival status ofpacts, in the economically backward rural society still shine, on the contrary, it isincreasingly recognized. In those few backward minorities in remote areas, pactsfunction is still evident, and its authority is still to get the majority of the villagersrecognized. In academia, because the penalties pacts also caused no small controversy,then discusses the legal aspects of it is very necessary that some practical value pactsexist or worthy of recognition, it is necessary for the village bylaws people about theexistence of a space reserved, but obviously conflict with state law, the provisions ofthe fundamental rights of citizens damage that must be corrected.This paper is divided into four parts.
