A Study On The Legal Issues Of Anti - Subsidy To Foreign Countries In China

Since the reform and opening up, China has gradually become the internationalagricultural products production and export country, agricultural industry as China’straditional industries, to undertake the international transfer of global agriculturalindustry. With the accession to the WTO, tariff China and constantly promote theliberalization of trade, exports of agricultural products Chinese rapid growth, usheredin a period of rapid growth, occupy a larger share of the international market.However, a higher market share for both developed and developing countriesagricultural economic impact, resulting in foreign countries on China’s exports ofagricultural products to resist, so that our agricultural products become one of themost serious due to the influence of industry trade protection. The countervailing,anti-dumping and safeguard measures is the frequent introduction of new tradeprotection policy of three trade relief measures stipulated by WTO as therepresentative, our single enterprise is very difficult to system of trade measures onforeign do all-round understanding. Therefore, in the new international tradeprotectionism under the background of the problem, the countervailing, has strongpractical significance.This paper is to America China’s first agricultural products anti subsidy caseperspective, in-depth analysis of the subsidy and anti subsidy theory, a clear course ofdevelopment of anti subsidy and trend of agricultural product trade of our country andnow faces the international anti subsidy situation and its causes, to explore a set offeasible solutions for the related industries and enterprises, so as to effectivelycircumvent the foreign anti subsidy policy, gradually reduce the countervailinginvestigation.The article is divided into four parts: the first part is the introduction of China’sfirst case of agricultural products countervailing case; in the second part, China’s firstUSA agricultural products countervailing case as the angle of view, this paperintroduces the related theory of subsidy and anti subsidy; the third part separately from the three angles of international background, reason and China itself on foreignChinese facing the situation of international anti subsidy are explained; the fourthchapter describes and analyses the results of Chinese, how to deal with foreigncountervailing investigation, and puts forward the corresponding countermeasures andsuggestions.In this paper, on the basis of relevant research results, using statistical tools, andbased on the analysis of the data and statistics, combined with the specific situationand influence of foreign agricultural products countervailing, proposed legal strategy,to provide a theoretical basis and reference value for export related enterprises frompredicament for the relevant departments to formulate policies.
