The topic is the identification of tort liability of false advertising. Therefore, weanalyzed the case in three chapters. The first chapter is the summary, divided into falseadvertising and tort liability of false advertisement. The first part is about the concepts and,comparison with false propaganda and proper exaggerated advertising.The second part isverifications and basic characters and the pattern and indemnification of tort liability, andcomparison with liability for breach of contract and product liability insurance. We alsointroduce the current legislation of our country. The second chapter is the identification oftort liability of false advertisement, divided into verification of false advertising, doctrineof liability fixation and elements of false advertising violations. I think different peopleshould use different doctrines. Elements of false advertising violations are carved up fourparts, illegal activities, results of damage, subjective fault, causality. In the last chapter, wemainly focused on indemnification. We write from the importance in the system ofidentification and types of indemnification.Through writing this article, the author has adeeper knowledge of the tort of false advertising, the foundation for further study andresearch.
