Study On The Transfer Of Land Contractual Management Right In Scale Operation Mode

"The Family Farm" has become a hot keywords according to China’s first policydocument of the year2013."To encourage and support the contracted land to professionalfarmers, family farms, and agricultural cooperatives, country has developed various formsof moderate scale management. Moderate scale management has make a difference on thelevel of agricultural production and operation scales. Orderly transfer of land contract andmanagement rights is an important precondition. However, the problem is that the existinglegal system and policies are mostly a matter of principle and directional guidance, that isto say, there still exists some imperfections which will make obstacles on the issue oftransfer of land contract and management right orderly as well as restrict the developmentof moderate scale management. Therefore, it has a great importance to study from thetheoretical and practical aspect on the transfer of land contract and management rightorderly under the mode of the moderate scale management. In this paper, the text isdivided into three parts:The first chapter: the essay analyses the relationship between the moderate scalemanagement and orderly transfer of land contract and management rights. Firstly, theessay will point out that the land moderate scale management is the inevitable trend ofeconomic and social development; Secondly, this paper points out that the right to thecontracted management of land circulations is the premise of the land scale management;Finally, the essay analyzes the defects of the land transfer contract and management rightorderly and the hard situation of the practice of the moderate scale management.The second chapter: the essay will state the moderate scale management under thecontracted management of land circulation from a whole aspect. Firstly, it will put forwardthe problem of efficiency and fairness in the contracted management of land circulation;Secondly, it points out that the right to the contracted management of land circulation inthe moderate scale management should follow the value orientation. The third chapter: the essay will state the moderate scale management to thecontracted management of land circulation system arrangement from a specificperspective. Including how to complete right to the contracted management of landcirculation respectively from the angle of legal system and other supporting systems.
