The transition of democracy is the premise and basis of constitutionalism, andthe establishment of the constitutionalism is the ultimate goal of politicaltransformation. Democratic political transformation refers to the change of nationalpolitical system, social order and legal norms from authoritarian regime to democracy;and the constitutional construction is not only the combination of the democracy, therule of law and human rights, but also the political process from the beginning ofabandoning authoritarian regime, creating the constitution reflecting the constitutionalspirit, to the ends of realizing the democracy, the rule of law and human rights.Since the release of the first constitution in1993, Kyrgyzstan has opened theprocess of constitutionalism construction, aimed to develop the country to be the“democratic island in Central Asiaâ€. However, the frequent constitutional crisisexacerbated the domestic power struggle. Soon, as a manifestation of politicalauthoritarianism, centralized presidential system in Kyrgyzstan return, which madethe constitutionalism construction of Kyrgyzstan seriously deviated from the originalpath. As the two large-scale constitutional crisis, the two revolution ("TulipRevolution" of2005and "April revolution" of2010) overthrow the political powerof the country by the means of non-systematic riot, further exacerbating the noninstitutionalized political operation, causing social chaos and political unrest. Inaddition, Kyrgyz authority has amended the constitution as many as8times in lessthan20years (6referendums), further aggravating the imbalance of power, whichseverely damaged the authority and effectiveness of the constitution, breached theconstitutional principles and constitutional system, and eventually led to constitutionalcrisis, which hinder the process of political transition and constitutionalismconstruction. |
