Behavior Analysis And Legal Protection Of Infringing Personal Information In Network Environment

With the advent of the internet information age and the era of big data, personalinformation is more and more important. Protection of personal information on line invarious countries around the world have attracted more attention. In recent years,violations of personal information on the interet often occur, causing very seriousconsequences, the value of personal information does not get enough attention, ourlaw experts is also very concerned about the personal information. This dissertationdiscusses the concept of personal information, combined with relevant legislation toprotect personal information in other countries and regions, to provide reference forout our internet protection of personal information. This dissertation is divided intofive sections.The first section introduces the concept of personal information and the characteristics,Using normative analysis and comparative analysis method, summarizing thedomestic and foreign relevant laws and regulations and scholars’ views, concludingthat the nature of personal information is personality rights and property rights.The second section introduces the personal information rights and its connotations,such as the right to access personal information, confidentiality, the right of correction,sequestration rights, delete rights, income rights, right to decide, etc.The third section analysis the infringement of personal information behavior andcharacteristics under the background of Internet, mainly discusses the collection andprocessing of internet personal information.The fourth section introduces the situation of extraterritorial personal informationprotection legislation, mainly the European Union, the United States and China’sTaiwan region, to give some reference for legislation on China.The fifth section is based on our current situation of laws and regulations to protectinternet personal information, combined with relevant laws and regulations of othercountries and regions and some scholars’ researches, put forward four suggestions toprotect the personal information on line: speeding up the personal informationprotection law and particular regulation for protecting the internet personalinformation， strengthening internal internet industry self-regulatory mechanism,regulating the internet industry self-regulatory mechanism and propagating NetworkSecurity to public.
