In this paper, take "Pengzhou ebony case" for example,I will discuss about theownership of ebony, which had gain o lot of attention. First I will discuss the details ofthe case, the process of litigation, legal disputes, and then expand the detaileddiscussion on the hidden problem of legal theory. Finally, the purpose is to analyze thelegal property of ebony, thereby determining the ownership of the ebony.This paper is divided into four parts. The first part, I analyzed the case of atypical ebony, mastered the controversial points, find out the difficult of legalapplication.Now, a variety of perspectives and learn Dharma community users viewon the case, are numerous. Their views and reasons are mentioned in this section. Thesecond part, combined with current legal system, find the applicable laws, regulationsetc. The third part, at the theoretical level, analysis of the potential for ebony naturaland social properties analyzed one by one. And then analysis ebony whether is fossils,artifacts, minerals, and natural fruits, treasure trove, hidden object, and other legaltheory bona issues. The fourth part, by paving the way earlier, I come to theconclusion that ebony property is the product of land. Then describes the theoreticalbasis and legal basis of why ebony property is the product of land. The latter of thefourth part, I will focus on the analysis Ebony attribution. As Our country’s land isdivided into State-owned land and collective land, ebony thereby has different owner.Then I will analyze the distribution of benefits ebony which is found inCollective-owned land.
