Ebony, also called "Oriental shenmu" and "plants, mummy", has the classic elegance of wood and the verve of stone. It is said in folk that a box of jewelry not better than an inch of ebony, signifying its precious. In recent years with the growing rise value of ebony in the market, mining and trading with ebony have become increasingly frequent. It has formed an ebony industrial chain from the origin of Sichuan province to Beijing, Shanghai and Guangzhou provinces. It also caused ownership dispute between government and individual when the ebony mined individual. Due to the lack of legislation in our country, it is hard to judicial define who is the really owner by law. Therefore, the ebony owner may different while the legal cases are similar.In this paper, Pengzhou ebony case was used as an example to analyse ebony legal property from its qualitative, explore concurrency under the current legal system in our country now ebony belonging problem facing predicament, and further put forward advice on how to perfect relevant legislation, in order to handle similar cases for our country judicial organ to provide some valuable theoretical basis and decision-making reference.In this paper, the text is divided into three chapters, the first chapter describes the case facts of pengzhou, Sichuan ebony, and introduces the focus of dispute; then focuses on the controversy surrounding the cases of different views; finally, puts forward legislative suggestions and practical solutions to resolve the problem.
