| As the development and extension of financial law，financial services law plays animportant role in maintaining financial stability and guaranteeing economic security,thus, the significance of the research on financial services legal system is obvious.With the promotion of the research on financial services law in the world and thestimulation of economic crisis in2008, a research boom also appears in our country,leading to a lot of excellent books and papers concerning on financial services law,and acting a vital part in the promotion of the research on financial services law.Following the steps of other researchers, the writer also does exploratory researchon the issues concerning on financial services law. This paper not only states somebasic knowledge of financial services law, but also introduces the legal principles offinancial services law of WTO and the financial services legal system of England anAmerica, analyzes the current situations and existing problems of financial serviceslegal system of our country, and puts forward some reasonable suggestions to perfectour financial services legal system.This paper, with about26,000words, can be divided into four parts: the first part isabout the basic knowledge of financial services law, including the definition,connotation, features and the necessity of regulating the financial services industrywith law; the second mainly discusses the international legislation and nationallegislation, in terms of international legislation, the writer mainly introduces the legalframework of financial services of WTO and basic legal principles of financialservices of WTO; in terms of national legislation, the writers lays stress on thefinancial services legal systems of England and America, which have developedfinancial services industry and relatively perfect financial services legal system; thethird part focus on the current situations and existing problems of financial serviceslegal system of our country; on the basis of analyzing the problems mentioned aboveand summarizing the successful experience of England and America, the last part ofthis paper comes up with some practical and reasonable suggestions to perfectfinancial services legal system of our country from aspects of financial legal system and financial regulation system.Aiming at making contribution to the improvement of financial services legalsystem of our country, this paper puts forward some suggestions to perfect financialservices legal system according to the practice of our country and the successfulexperience of other countries by doing research on financial services legal system ofEngland and America and on current situations and existing problems of financialservices legal system of our country. |
