A Comparison Of The "People 's Image" In Sino - German Constitution

This article is based on a theory of "literal man" in the German philosophy and anthropology. Through dimensional investigation and explore the Federal Basic Rules of Germany and Chinese Constitution, I have come up with such a theory which is that the Federal Basic Rules of Germany has established a figure of self-realization and the current Chinese Constitution has molded a figure of destination. On the first chapter, I have discussed how to recognize and understand the concept of "people" in our constitution, which is of course the theoretic base of the post-chapter. At the end of this chapter I will specifically conclude two principles to recognize and understand the concept of "people’s figure" in our constitution. On the second chapter, I have discussed that the concept of "people’s figure" in German Constitution is just about man of self-realization through different aspects including German legislations, the philosophical meanings of rules and the cases in the German constitutional court. On the third chapter, I have focused on the concept of "people’s figure" in the Chinese constitution, summarizing that the concept of "people’s figure" in Chinese constitution is about people of destination from different aspects including the name of people in Chinese constitution, the value of doctorial cultures, the ideology of Chinese constitution and the conflicts of citizen’s rights and cultures. On the fourth chapter, by comparing two different "people’s figures" in China and Germany, I have concluded that the essential difference between Chinese constitution and German constitution is the establish of different concept of "people’s figure". In the meantime, I have raised the necessities of changing this concept in Chinese constitution and put some considerations about the ways to make these changes. Finding a theory which is compatible with the current ideology in Chinese constitution, refreshing and exploring the theories about developing people comprehensively and freely in Marxism would be helpful. The concept of people in Chinese constitution would be the people of comprehensive and free development.
