The Malpractice And Perfection Of People 's Jury System In China

Since30’s of the twentieth Century, although the system of people’s assessors had been abolished it still is one of the important judicial systems in China at present. The debate about whether to abolish the system of our country to introduce the jury system has never cease. There are mixed views of the system. Some people think that it can fully reflected the judicial democracy and justice under the environment of our country and effectively curb the judicial corruption. Some people think that although it has perfect regulations of law it exists in name only because of no obvious actual effect. This article believes that the reasons for these arguments are the history of the system of people’s assessors is not long and the system also has drawbacks itself.This article hopes that through combing the provisions of law about the system of people’s assessors and the problems arising from the practice to point out a series of problems exist in the law and practice. This paper also analyzes the causes of problems in practice.To solve the problems existed in the system of people’s assessors we need to improve the provisions of the law and develop specifications for practice. First of all, we should establish a perfect system and formulate detailed legal provisions about people’s assessors so that people have rules to follow in practice. Secondly, this paper wants to conduct norms in practice and solve the situation of no unified standard about the system of people’s assessors. This paper mainly about the determination of the number of people’s assessors,qualifications,training,assessment,recognition,subsidies and the other aspects of people’s assessors. This paper wants to organize and solve questions about those aspects. In addition, the improvement of the system of people’s assessors also needs the related reform of political systems and judicial systems.
