An Analysis Of The Administrative Law Of "The New Deal Of Fenghuang Ancient City"

In the background of the social affairs becoming increasingly complex, it isnecessary for the government to make a series of regulatory policies to achieve itseffective control of society. But regulatory policies of the government must havea legal basis for rationality, and it should not become the tool of abusingexecutive powers.This paper takes the hot government control event in2013--"new ticketpolicy of phoenix town" as the breakthrough point, on the comprehensiveanalysis of the perspective of administrative law, we can conclude that theChinese government on the regulatory policy, select the control tools whichexposed to a series of problems, and I put forward corresponding suggestions tooffer some beneficial reference for promoting the rule of law governmentconstruction in China.Except the introduction part, my paper can be divided into four divisions. Inthe first part, I mainly introduce the information of "new ticket policy of phoenixtown"，control policy, control background, stakeholders, etc. That provides thebasis of facts and data with administrative law analysis. In the second, I focus onthe traditional judicial aspect to analyze the "new ticket policy of phoenix town".Through legitimacy and rationality of the analysis, I made a conclusion that itslegitimacy and rationality of double lfaw reason. In the third part, I look at the"new ticket policy of phoenix town" behind the lack of relevant policies andprocedures to construct，and puts forward the corresponding suggestions. In thefourth part, I attempts to the perspective of more upstream，which namely thepolicy law, to look at "new ticket policy of phoenix town". I attempt to tell thereaders and the government how to establish a legitimate regulatory goal, how touse the scientific method to choose the regulatory tools，in order to achieve thebest control result.
