The Innovation Of Administrative Law Enforcement And Its Guarantee

The concept of the rule of law requires the administration according to law, administration according to law is the core of the construction of the socialist rule of law government, it is the inevitable trend of social development to change the ways of law enforcement. Nowadays, all kinds of violent conflicts happen all the time, this leads to the instability of the society and greatly increases in administrative costs, what makes the whole social governance costs surge, the above is not in conformity with the people-oriented concept and against the smooth realization of the harmonious society. In the process of administrative law enforcement, how to make the object of law enforcement adapt to the new changes of the society and change the ways of law enforcement to make the way of administrative law enforcement can be guaranteed is an urgent and realistic problem.Different types of law enforcement can realize different legal purpose. Change the ways of law enforcement to make the citizens show understanding and cooperation to the law enforcement agencies’ work, it benefits to improve the efficiency and effectiveness of law enforcement. After a preliminary understanding on approach of administrative enforcement, this paper represents all kinds of problems in this area including civilized deficiency, intermittent enforcement, interest orientation. Facts including low quality of law enforcement officers, imperfect legal system and unreasonable oversight mechanisms account for this phenomenon based on analysis. Finally, based on the present situation and the cause, this paper proposed a suggestion on how to transform the way and ensure the safety of law enforcement from three aspects which are to achieve democratic administrative enforcement and introduce reconciliation to improve it, to make it effective in concept and regulations, to set up perfect administrative law system to regulate administrative discretion and make it transparent under the public’s supervision. With these facts, transformation is not easy to realize, this paper will provide implications on the practice of administrative enforcement in our country on how to reduce the resistance of the transformation.
